Labour Laws and other Labour Regulations

In the context of preparation of the Eleventh Five Year Plan (2007-2012), it has been decided to set up a Working Group on Labour Laws and Labour Regulations with die following composition:

2.   The Terms of Reference of the Working Group will be:

  1. To review Labour Laws and other labour regulations and to suggest modifications which would help to expand regular wage employment.
  2. To suggest appropriate measures so as to ensure healthy industrial relations and promote productivity among workers.
  3. To suggest initiatives in the legislative and administrative domain diat will strike a balance between protecting the interests of labour and the need for providing operational flexibility to companies which might contribute to a faster growm in employment in organized sector.
  4. To examine the need for special measures that need to be taken for Special Economic Zones, Industrial Parks, Export Zones, and odier locations/ activities that foster creation of large new employment opportunities.
  5. To examine the nature of existing labour laws in relation to regulatory activities, provision of social security and labour welfare in the smaller establishments.
  6. To suggest an approach towards contract labour, in particular the measures to provide social security.
  7. To Identify the Laws, wliich (i) are no longer needed and need io be repealed; (ii) are in: harmony with die climate of the economic liberalization and hence need no change; and (iii) require changes and revision in the rules, regulations, orders and notifications etc. issued thereunder. (h) To examine the extent of coverage of labour through the monitoring and reporting system at state and Central Government level in regard to the implementation of labour laws.

3. The Chairman of the Working Group may include any additional term(s) of reference in consultation with Member (Labour and Employment), Planning Commission, who is also the Chairman of the Steering Committee on Labour and Employment.

4. The Chairman of the Working Group may co-opt any other expert as Member of die Working Group.

5. The Working Group will submit its report by April 30, 2006. The Working Group will be serviced by the Ministry of Labour and Employment.

6. The expenses towards TA/DA of the official members will be met by their respective Government Departments / Institutions to which they belong as per the rules of entitlement applicable to them. The TA/DA of non-official Members will be borne by die Ministry of Labour and Employment as admissible to Class I officers of the Government of India as per SR 190(a).

7. Shri S.K. Saha, Joint Adviser, Room No. 277, Yojana Bhawan, Sansad Marg (Tel. 23096771) will act as the Nodal Officer and any further communication in this regard may be made with him.
